1. Company Information

1.1 RivalBet is the trading name of Apthletic Australia Pty Ltd (hereafter 'RivalBet'), ACN 623 634 015, a company incorporated in Australia under the Corporations Act 2001 (Cth). RivalBet (collectively, 'We', 'Us' or 'Our') offer a portfolio of gambling products and services (hereafter 'Product'). 'Website' refers to any websites or mobile phone applications that are owned and/or operated by us.

1.2 RivalBet provides its Product in accordance with its licence and is regulated by the Northern Territory Racing Commission ('NTRC'). RivalBet is the holder of a betting exchange licence issued under the Racing and Betting Act 1983 (NT). RivalBet complies with the Northern Territory Code of Practice for Responsible Gambling and the South Australian Responsible Gambling Code of Practice.

1.3 RivalBet complies with Australian law, regulations and guidelines of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) ('Act'.)

2. Acceptance of terms

2.1 RivalBet reserves the right to change, amend or add to these Terms and Conditions and the Privacy Policy at our discretion, and will publish such changes on our Website. You agree that any changes, amendments or additions published on our Website will be taken to be effective immediately. It is the Member's responsibility to ensure that they are aware of the current Rules and Privacy Policy.

2.2 By opening an Account, you are deemed to have read and accepted these Terms and Conditions and RivalBet's Privacy Policy, https://support.rivalbet.com.au/privacy_policy.html

2.3 You agree that the service offered by RivalBet is the ability to place a bet, win or lose.

3. Your Account

3.1 You must be at least 18 years of age to open a betting account with RivalBet ('Account'). To open an Account, you must provide your name, email, address, date of birth, residential address, and any other information or consents required by RivalBet.

3.2 A 'Member' is a person who holds an Account, and any reference to 'you' or 'your' in these Terms and Conditions is a reference to a Member.

3.3 You must be of sound mind and capable of taking responsibility for your actions and entering into a legally binding agreement.

3.4 We do not permit Accounts to be opened by, or used from, Members who reside outside of Australia. You agree that you shall not open an Account, nor attempt to use your Account, if you are outside of Australia. RivalBet reserves the right to suspend an Account pending a full investigation, without notice and we may request information to help with the investigation.

3.5 For security purposes you may hold only one Account per person. If more than one account is discovered RivalBet reserves the right to suspend or terminate any or all of your Accounts and terminate, withhold or revoke the payment of any winnings.

3.6 Members are responsible for complying with their own local, state or national laws concerning betting prior to either applying to become a Member or placing a bet on their Account.

3.7 Members shall ensure all personal and payment details are kept up to date. In the event that a Member has not kept their Account details up to date, we reserve the right to suspend the Account.

3.8 Your Account will become inactive when there has been no recorded betting activity for 12 consecutive months ('Inactive Account'). We will charge you a fee of $5 per calendar month ('Administration Cost') which will be deducted from your Account (unless your Account balance is $0). To avoid the Administration Cost, you can simply place a bet or withdraw your funds into your bank account. If this occurs your Account will no longer be deemed an Inactive Account.

3.9 RivalBet reserves the right to close the Account if a Member is in breach of these Terms and Conditions, Member becomes bankrupt, operates account in a fraudulent manner or otherwise as RivalBet considers is reasonable or necessary to do so in its absolute discretion. In order to return funds, RivalBet may request personal identification and bank account information prior to processing any funds in the Account.

3.10 RivalBet may periodically review Accounts to monitor any activity that it might consider unusual. In this instance, RivalBet reserves the right to suspend an Account pending a full investigation, without notice. If an Account is suspended, all funds will be held until the full investigation is completed.

3.11 A Member is solely responsible for the security and confidentiality of their account ('Secure Member Details'). You must notify RivalBet immediately if you suspect that your security details may no longer be confidential or that there may have been unauthorised use of your Account.

3.12 Members will be responsible for all bets on their Account in which their Secure Member Details are used.

3.13 RivalBet’s Product contains adult content and is intended for use by persons over the age of 18.

4. Betting

4.1 RivalBet provides a betting exchange where Members can bet on a variety of markets against each other.

4.2 All bets on our exchange are considered to be placed and received in the Northern Territory, Australia.

4.3 Members can enter a bet via our Website. Bets cannot be placed or accepted over the phone.

4.4 A bet is accepted once the Member confirms a bet and RivalBet issues a betting receipt number.

4.5 Members may not change or cancel a bet once a betting receipt number is issued by RivalBet.

4.6 RivalBet may choose to top up a betting market at its discretion at no additional cost to its Members.

4.7 Member minimum bet amount is AUD$0.01. Member maximum bet amount is AUD$5,000.

4.8 RivalBet charges a commission based on the value of the betting market at a base rate of 15%. RivalBet reserves the right to reduce the commission rate and shall not increase the base rate above 15%.

4.8.1 Commission is charged only to winning Members. No commission is charged to Members on losing bets.

Example: Market 'One' has 10 Members who each bet $10. The Market has a value of $100. If one Member correctly holds the winning bet, RivalBet commission charged is $15, the winning Member collects $85. The 9 losing Members incur no additional cost to the original $10 bet.

4.8.2 If no Member holds the winning bet for a market the market will be deemed void, all Members who entered the market will be refunded.

Example: Market 'Four' has 10 Members who each bet $10. The Market has a value of $100. If no Member holds the winning bet, each Member would be refunded $10. RivalBet commission is $0.

4.9 Members may create new bets to be offered on the exchange. When a member creates a new bet they must choose from a list of approved market templates. RivalBet will also create new bets to be offered the exchange but not participate in any such bets.

4.10 Members will act in good faith at all times.

4.11 Members will not place bets in breach of any sporting rules, regulations or code of conduct which apply to you.

4.12 RivalBet reserves the right to provide an Australian governing sporting body with:

Such information will only be provided to assist in a legitimate inquiry conducted by an Australian governing sporting body to maintain the integrity of the sport. For the avoidance of doubt, the Member consents to RivalBet providing the above information to an Australian governing sporting body.

4.13 For the purpose of Rule 4.12, 'Australian governing sporting body' is an Australian sports organisation that has a regulatory or sanctioning function and includes each of the Australia State and Territory Thoroughbred Racing, Harness Racing and Greyhound Racing peak bodies, the Australian Football League, Athletics Australia, The Australian Rugby Union, Cricket Australia, The National Basketball League, the National Rugby League, Swimming Australia, Tennis Australia, Football Australia and Golf Australia.

4.14 RivalBet reserves the right at any time to refuse any bet or part of a bet without providing a reason or advance notification. The circumstances in which we may refuse a Member’s bet include but are not limited to:

  1. a Member is or may be less than 18 years of age;
  2. a Member is or may be betting on behalf of a person who is less than 18 years of age;
  3. a Member is or may be in breach of these Rules;
  4. a Member is or may be in breach of any applicable law; or
  5. a Member’s proposed bet would present an unacceptable liability risk to our business. Whether there is an unacceptable liability risk for us for the purpose of this Rule is at RivalBet’s discretion.

4.15 RivalBet does not represent or warrant that any bet by a Member on their Account or the acceptance of any bet on an Account by RivalBet complies with the legal requirements of any state or country other than the NT. Members must satisfy themselves (and assume full responsibility) for the legality of:

  1. Applying to RivalBet for an Account;
  2. Remitting funds by Credit card or other permitted means to an Account;
  3. Placing bets with RivalBet; and
  4. Receiving winnings from RivalBet.

4.16 Multi Madness (hereafter 'Multi') is a special type of bet spread over multiple legs.

  1. A minimum of 80% of the legs in a multi have to be completed in order to receive a payout. Otherwise, all bets will be refunded.
  2. In the event of one or more legs being deemed void, any selections made for these legs will be deemed a winner for settlement purposes.
  3. In the event of a dead heat, all selections involved in the dead heat will be considered winning selections for settlement purposes.
  4. In the event of no member choosing all the correct selections for the multi, your money will be refunded, unless we stipulate money will be rolled over into the next multi prior to entering the multi.
  5. To be eligible for the cash prize of a multi, you must enter a selection for every leg in the relevant multi. Failure to compete all leg selections for a multi will result in a loss of funds.

5. Bonus Bets and Offers

5.1 At the sole discretion of RivalBet we may elect to reward members with "Bonus Bets", "Offers" or "Bonus Credits".

5.2 You are only entitled to a Bonus Bet or an Offer if we have communicated it to you directly.

5.3 Bonus Bets and Offers may feature restrictions on the bet type or betting market.

5.4 SA & WA residets are excluded from all promotions.

5.5 Bonus Bets are not transferrable or exchangeable other than in RivalBet's sole discretion.

5.6 A Bonus Bet is valid until the expiry of the offer stated in the Bonus Bet promotion.

5.7 Bonus Bets and Offers are only open to bona fide account holders, who always act in good faith and with integrity and who place bets for the purpose of entertainment and recreation and comply with RivalBet's terms and conditions.

5.8 Bonus Bets and Offers are available to members who receive a Bonus Bet or an Offer that is specifically addressed to that Member and the bonus bet is only available to and capable of being redeemed by that Member.

5.9 A Bonus Bet or Offer is only open to you if:

  1. You are over 18 years of age
  2. You have an Account with RivalBet
  3. You are a resident of Australia or New Zealand

5.10 We reserve the right to change any terms related to Bonus Bets and/or Offers at any time before, during or after a promotion.

5.11 Should your Bonus Bet be successful, only the winnings from the Bonus Bet will be credited into your Account. This means that your winnings will exclude the initial Bonus Bet stake. For example, a winning $100.00 bet using a $10.00 Bonus Bet will credit winnings of $90.00 into your Account.

5.12 Bonus Bets and Offers are non-refundable or redeemable for cash.

5.13 Bonus Bets or Offers may take up to 24 hours to be credited to your acount once an event is completed.

6. Event Rules

6.1 Markets are settled in accordance with our Event Rules, https://support.rivalbet.com.au/event_rules.html

7. Identity Verification

7.1 RivalBet is legally required to conduct identity verification checks within 14 days of opening your account. If checks are not completed to our satisfaction, we are required to suspend the account until such time checks are complete.

7.2 All identity checks must meet the requirements as governed by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act). RivalBet may require further proof of identification in order for us to complete identity checks. Members who do not provide full details when requested may have their Accounts suspended, without notice, pending an investigation.

7.3 Members will be unable to withdraw funds from their Account until their identity is verified.

7.4 RivalBet may supply Member identification to a third party for verification. RivalBet may also use other public information services to confirm a Members identity. The verification process is not perfect and we cannot verify all of our Members this way. This is not a fault of individual Members.

7.5 All certified documents must be produced in the English language or they will be rejected. RivalBet reserves the right to carry out additional checks on any certifying documents and we may reject certified documents for any reason.

7.6 If any Member should deliberately falsify any identification documents or any other details when creating an Account or transacting on the Account, RivalBet reserves the right to suspend the Account pending a full investigation, without notice.

7.7 RivalBet may request legible copies of the front and back of any Prepaid/Credit/Debit/Travel/Virtual card used by a Member to fund an Account. RivalBet reserves the right at its discretion to refuse cards. Cards with a name other than that which is registered for the Account may result in an account suspension until adequate proof is received.

7.8 RivalBet may request photographic proof of a Member’s current address. Acceptable proof of current address may include:

8. Member Funds

8.1 To bet on RivalBet you need to deposit funds into your Account. Deposits into your Account can be made by any means provided via the 'My Account' feature in our Product.

8.2 RivalBet reserves the right to remove and add payment options from time to time. Currently available payment methods can be viewed within the ’My Account’ section of our Product.

8.3 RivalBet reserves the right to check directly with the Member’s funding institution that supplied the payment option used to deposit to confirm the details by the Member to RivalBet are valid and correct.

8.4 If RivalBet determines that funds deposited are not for the purposes of betting, RivalBet may in its discretion decline the deposit, return the funds to the bank account used to fund the Account, and close the Account.

8.5 If RivalBet determines that the funds deposited are not from a funding instrument in the Member’s name or are not expressly authorised to be used by them, RivalBet reserves the right to decline the deposit and return the funds to the original payment method. If this determination takes place after bets have been placed, RivalBet reserves the right to void any resulted or pending bets on the Account.

8.6 If RivalBet determines that there is not enough information to prove the owner of a particular payment option, RivalBet reserve the right to request certification documentation as proof of ownership prior to making any decision.

8.7 RivalBet must comply with the Act. Should RivalBet consider that a deposit or withdrawal may potentially be fraudulent, RivalBet reserve the right to request proof of deposit or withdrawal bank account information to verify that information provided is true and correct prior to permitting funds to be transferred to/from the Account.

8.8 If RivalBet determines that the risk present from a payment to or from an Account to be undesirable, RivalBet reserves the right to cancel the deposit or withdrawal.

8.9 If RivalBet successfully identifies third party payment transactions on an Account; RivalBet reserves the right to remedy the situation. Members accept that any bets placed, or still pending may be voided and funds returned to them. Members accept that RivalBet will review each situation on a case by case basis taking into account deposits, withdrawals, bets and any other information available. Members accept that when an Account has not been operated on a good faith basis that RivalBet may refuse future transactions and retrospectively void existing ones, at its discretion.

8.10 RivalBet reserves the right to place limits on deposits and restrict or prohibit withdrawals on any Account if the Member has not fulfilled the identity requirements specific in Rules 5.1 - 5.8 (inclusive). If 14 days have passed since the Account was opened, RivalBet must suspend the account until the identity requirements have been satisfied.

8.11 RivalBet requires that any deposits into an Account be turned over at least once prior to authorising a withdrawal from the Account.

8.12 Members are solely responsible for all bets placed and activity on the Account.

8.13 Members should check the balance of their Account each time they access their Account. In the event of a query, it is the Member’s responsibility to notify RivalBet immediately.

8.14 Transaction history of the Account is available for all Members. This will include, but not limited to all betting activity, payouts, deposits and withdrawals. The account balance will be included at the time of each transaction.

8.15 All transactions will be monitored to prevent money laundering. Any suspicious activity may be reported to the appropriate authorities. RivalBet reserves the right to suspend the Account pending a full investigation, without notice.

8.16 The funds in your account are held on your behalf to meet any payment obligations you may incur as a result of betting activity.

8.17 RivalBet does not offer credit betting and all bets must be supported by sufficient funds in your Account.

8.18 RivalBet maintains a separate bank account containing sufficient funds to match every dollar of Member funds in accordance with its Licence Conditions.

8.19 RivalBet reserves the right to pass on any transaction processing fees to Members. Credit card holders may incur a banking fee by their own banking institution on depositing funds with RivalBet, this is the credit card holders responsibility to pay.

8.20 All withdrawals are processed via Bank Transfer. The bank account provided must be in the Members name. Withdrawal requests will be processed within 2 business days. RivalBet is legally required to verify your identity before any withdrawals may be processed.

8.21 RivalBet reserves the right to request proof of bank account information. RivalBet may check directly with the Members institution to confirm details are valid and correct.

8.22 Charge backs

8.22.1 Members agree and warrant that no charge-backs or other cancellation of deposits will be made relating to your Account without our consent. In the event of any of the foregoing occurring, you agree to indemnify us from any costs, claims, damages and expenses relating to or arising in connection with this, including any expense incurred by us in recovering such amounts.

8.22.2 If a Member disputes a financial transaction on their Account relating to a third party (e.g. Bank, Credit Card), RivalBet may temporarily suspend your Account, without notice, pending an investigation by us relating to the transaction. If we incur any loss as result of that investigation, we reserve our right to cover such losses from you.

8.22.3 If you use any of RivalBet’s banking specific options (PayPal/POLi/BPay/EFT) you accept that RivalBet may request a certified or non-certified bank statement to verify where funds have originated from prior to any withdrawal being approved. You also accept that RivalBet may decide to return these funds at its discretion and void bets should it deem the funds may be unauthorised.

8.23 Fraud

8.23.1 RivalBet reserves the right to withhold deposited funds and/or winnings from resulted bets should we determine that a Credit card has been misused or used fraudulently. Any matters of inappropriate or fraudulent use of any Credit card will be reported to the relevant authority. The Account may also be permanently closed.

8.23.2 RivalBet may employ third party technologies to track and store technical information on the device that Members choose to use. Members accept that this data may be used to reach decisions on investigations where Accounts have not been operated in good faith, including but not limited to Account takeover, betting abuse, multiple Account operations, payment method abuse etc.

8.23.3 RivalBet reserves the right to close the Accounts of, and void any or all bets made by any person, group of people or corporation in an attempt to defraud RivalBet and/or its Members.

8.23.4 RivalBet may periodically review Accounts to monitor any activity that it might consider unusual. In this instance, RivalBet reserves the right to suspend an Account pending a full investigation, without notice.

9. Limitation of liability

9.1 Our Product is provided to you “as is”, without any kind of warranty.

9.2 RivalBet reserves the right to refuse, cancel, change or restrict the products or bet types and markets at any time with or without notice to Members.

9.3 Nothing in these Terms and Conditions shall limit our liability for death or personal injury arising from our negligence.

9.4 RivalBet’s maximum liability to you or any third party arising out of these Terms and Conditions shall be limited in amount to the relevant bet placed by a Member.

9.5 Any reference to a discretion which may be exercised by RivalBet under these Terms and Conditions means RivalBet’s sole and absolute discretion.

9.6 RivalBet products and bet types are intended for bona fide Members, that is, those Members who act in good faith, sincerely, without fraud, and who place a bet with RivalBet for the purpose of recreation and entertainment.

9.7 RivalBet reserves the right to close or suspend the Accounts of, and void any or all bets made by any person where, in RivalBet’s reasonable opinion, the Account has not been operated with integrity and/or the bet has not been placed on a good faith basis. RivalBet can, in its sole discretion, withhold any or all related funds in the Account pending the outcome of an investigation on the Account.

9.8 RivalBet reserves the right, in its sole discretion, to determine that a Member is not eligible for certain products, bet types or promotions.

9.9 Members acknowledge a betting market will be resolved and paid out upon an official result from a governing body of an event.

9.10 RivalBet has made considerable efforts to ensure that its betting exchange operates in a fair, efficient and accurate manner. To the extent permitted by law, RivalBet excludes all warranties (expressed or implied) related to or arising out of the betting exchange we offer and excludes any liability for direct, indirect or consequential loss, damage, expense or injury suffered by any Member arising out of

10. Errors

10.1 RivalBet makes every effort to ensure that no errors are made in setting and settling betting markets. RivalBet reserves the right to correct any obvious errors and to void any bets where such has occurred. Should this occur, RivalBet will endeavour to contact the Member by email or telephone from the information listed on their Account.

10.2 You will inform us as soon as you become aware of any errors with respect to your account.

10.3 You will forfeit any amounts shown to be in your account that result from human or technical error. RivalBet will endeavour to contact the Member by email or telephone from the information listed on their Account.

10.4 If a Member places a bet after an event has commenced or been completed, the Member agrees that RivalBet may retrospectively void the bet and demand repayment where Members available balance being negative (due to Member re-investing or withdrawing winnings paid in error). The amount required to return the available balance to zero is immediately due and payable.

11. Responsible Gambling

11.1 RivalBet is committed to providing a safe and responsible gambling experience, a large part of that experience is ensuring compliance with responsible gambling practises throughout Australia. The ​Interactive Gambling Act 2001 ('the IGA') prohibits, determines and regulates the use of interactive gambling services by Australian companies and users. The legislation creates a safe and responsible way of participating in interactive gambling.

11.2 RivalBet wants all Members to gamble responsibly and makes every reasonable effort to prevent self-excluded Members from returning and using our Product.

11.3 RivalBet provides the following features via the 'My Account' section of our Product. Members may also access these features through Support via email support@rivalbet.com.au.

  1. Self-assessment tools are provided to help Members manage their gambling activities.
  2. Temporary and permanent self-exclusion features if you feel that you have developed a gambling problem.
  3. Accounts may be closed permanently if you no longer wish to use our Product.

11.4 RivalBet is intended for individuals 18 years old and above. Person under the age of 18 are prohibited from gambling all over Australia. We are committed to preventing underage gambling on our Product including ensuring any marketing or promotion material is not targeted towards minors.

12. Member Satisfaction

12.1 Member satisfaction is one of our core values and we aim to offer a fair Product for Members to use and enjoy.

12.2 Members are encouraged to communicate directly with us via the 'Customer Support' feature in our Product. Members may also email us directly at support@rivalbet.com.au.

13. Dispute Resolution

13.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of the NT and subject to Rule 2.2 each Member irrevocably submits the non-exclusive jurisdiction of the NT Courts in respect of any dispute arising out of or relating to these Terms and Conditions or the provision by RivalBet goods or services to Members ('Dispute').

13.2 As a first point of reference, you should direct your dispute to the Customer Support team by emailing support@rivalbet.com.au

13.3 If any Dispute cannot be resolved between RivalBet and the Member, you can lodge a dispute/complaint with the Northern Territory Racing Commission via the online 'gambling dispute form' at https://nt.gov.au/industry/gambling/complain-about-a-bookmaker/gambling-dispute-form. A Dispute must be lodged with the Northern Territory Racing Commission within 14 days of the Dispute arising. The decision of the Northern Territory Racing Commission is final and binding on RivalBet and the Member. Nothing in this Rule precludes a party from seeking urgent interlocutory relief from a court if such relief is reasonably required.

13.4 Any complaint or queries regarding missing Bets should, if possible, be supported by a copy of the 'bet confirmation' print out (if available) together with full details of the missing Bet.

13.5 No rule of contract interpretation may be applied in the interpretation of these Terms & Conditions to the disadvantage of a party on the basis that is prepared or put forward by these Terms & Conditions or any document format part of these Terms & Conditions.
